GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – Scope and nature of the sale
This sale is a private sale, organised according to an auction mechanism, but without the intervention of a sworn auctioneer or public officer. It does not constitute a public auction within the meaning of Articles 229 to 236 of the Swiss Code of Obligations (CO). It is governed by the general provisions of the law of obligations (Articles 1 to 40 CO) and by these General Terms and Conditions of Sale.
Article 2 – Registration
Anyone wishing to participate in the sale must register in advance by providing a valid identity document, proof of address, and completing the form provided for this purpose. A number or identifier will be assigned to it. The organizer reserves the right to refuse registration if the established conditions are not effective.
Article 3 – Operation of the sale
The sale takes place according to a progressive auction system. The organizer is free to set the rules for the process, to change the order of presentation of the lots, or to collect a prize at any time. The last price offered and accepted by the organizer constitutes the successful bid.
Article 4 – Reserve price
Some lots may be subject to a minimum sale price, which is not communicated to the public. The organizer reserves the right not to validate an offer if it does not reach this threshold.
Article 5 – Presentation and description of the lots
The descriptions of the lots are drawn up with care but without absolute guarantee. Buyers are invited to examine the objects during the preliminary exhibition. No dispute will be accepted after validation of the final price.
Article 6 – Invoicing & sales regime
In the context of the Lugano Auction Signatures private sale, two invoicing regimes are distinguished according to the nature of the lot and its owner:
A. Lots belonging to private sellers (not subject to VAT) will be invoiced directly by said owners. Payments must be made on the bank details provided at the time of the sale (IBAN of the private collector). In accordance with the legislation in force, these sales are exempt from VAT. No additional fees will be applied by the organizer.

B. Lots belonging to the Swiss organizing company
Lots held directly by the Swiss company organising the event will be invoiced by the latter. The price indicated is exclusive of taxes. VAT at the current rate (8.1%) will be added to the prize price at the time of invoicing. The company reserves the right to apply an additional margin of 8 to 10% in the event of specific costs related to the conservation, storage or provision of the property.
Each lot is identified according to its regime in the catalogue or on request.
Article 7 – Payment & Transfer of Ownership
Payment must be made within five (5) business days of acceptance of the offer. No prize will be awarded until full payment is made. Payments are made exclusively by bank transfer, to the contact details specified by the seller or the company according to the applicable regime. No cash payment will be accepted

Article 8 – Failure to pay
In the event of non-payment on time, the lot may be reassigned. Management or standby fees may apply.
Article 9 – Collection and delivery of lots
The lots must be collected within the deadlines communicated. No early withdrawals will be allowed. The costs of transport, storage or insurance after the sale are the sole responsibility of the buyer.
Article 10 – Liability
The organizer accepts no liability for indirect damages, delays in delivery or loss after collection. It can only be held liable in the event of serious or intentional misconduct.
Article 11 – Confidentiality
All data collected is treated with the strictest confidentiality. It will not be communicated to any third party without express authorization, unless legally required.
Article 12 – Applicable law and jurisdiction
These terms and conditions are governed exclusively by the Swiss law of Ticino. Any dispute relating to the sale will be submitted to the jurisdiction of the registered office of the organizer, unless otherwise stipulated. In the event of any contradiction between language versions, the Italian text shall prevail.
